do you think that it is fair to have to have a charge against someone in order to have an order of protection (restraining order) placed against them.
this is why i am asking. i was recently involved in a case in which a domestic dispute took place in front of me. the man involved ripped the phone lines out so that i couldn't call the police. i was taking care of his daughter and he ripped her out of my hands a couple times b/c he knew i was going to take her some place away from him so that he couldn't hurt her too. i went to the police and they told me that i had no charges against him so i could not place an order of protection against him. his gf told me that he was going to kill me when he got out of jail... which just so happened to me tonight.
