Wrongful death?

mum expired. [EVERYONE]

I have a friend who committed suicide 2yrs ago. She was in the psyche ward at the hospital at the time. she was left her there thinking that the hospital would watch her. They told us she would have a sitter and would be watched 24hrs. The next day she hung herself in the bathroom. How did this happen in a watched ward? her family is currently suing the hospital for wrongful death. the hospital is taking the stance that she would have done it anyways so they shouldnt have to pay even though they admit to not watching her. So my question is do you think the hospital should pay should pay?
