According to U.S. Laws... In order to broadcast music, one must pay Royalties to the artists per song played, per person listening. It has been brought to the attention of ASCAP (The American Society of Composers, Authors and Publishers) that MANY lounges in Fubar are streaming illegal stations. Talking to many Lounge owners, they all seem to ask the same question... Can I be sued....
Here is a quote taken from the ASCAP Page... ------------ "12. Aren't musicians, entertainers and DJ's responsible for obtaining permission for music they perform?
Some people mistakenly assume that musicians and entertainers must obtain licenses to perform copyrighted music or that businesses where music is performed can shift their responsibility to musicians or entertainers. The law says all who participate in, or are responsible for, performances of music are legally responsible." ------------
So my question is this...
Since being responsible for the lounge that plays a radio station that is illegal can be sued, should the lounge owner be notified if the internet radio station does or does not pay performance royalties to artists affiliated with ASCAP, BMI, SESAC and SoundExchange and are or not DMCA and RIAA compliant?
