According to ASCAP (The American Society of Composers, Authors and Composers)...ANY Public Performance of music needs to pay royalties per artist and per person listening per song. According to the FAQ...
"2. What is a public performance?
A public performance is one that occurs either in a public place or any place where people gather (other than a small circle of a family or its social acquaintances.) A public performance is also one that is transmitted to the public; for example, radio or television broadcasts, music-on-hold, cable television, and by the internet."
And According to ASCAP, those that can be sued for breaking the law are..
"12. Aren't musicians, entertainers and DJ's responsible for obtaining permission for music they perform?
Some people mistakenly assume that musicians and entertainers must obtain licenses to perform copyrighted music or that businesses where music is performed can shift their responsibility to musicians or entertainers. The law says all who participate in, or are responsible for, performances of music are legally responsible."
From KNOWING all copyright laws... let me assure you that:
IF YOU OWN A LOUNGE THAT BROADCASTS a radio station that does not pay all royalties, YOU AS THE LOUNGE OWNER (and FUBAR for letting these illegal stations to perform on their server) can be sued and loose hundreds of thousadnds of dollars.
So QUESTION: IF you are operating a lounge..
Do you: A) Find out if the station you are broadcasting is ACTUALLY following the law (it costs around 30K a year to do so legaly) OR
B) It is not my problem, let them sue me and I am willing to loose everything I have ever worked for?
LOUNGE OWNERS: You have the right to know if the radio station you are using pays performance royalties to artists
affiliated with ASCAP, BMI, SESAC and SoundExchange.
AND if they are fully DMCA and RIAA compliant. If NOT, YOU can be LEGALLY LIABLE!
